Conditions of  use
1. Contract
Anwell Holidays is a trading name of A Dudley, S Jones and R Ladell of 37 Redhills Road, Arnside, Carnforth, Lancashire LA5 0AR.

The contract entered into is between the owner of the holiday accommodation and the holidaymaker (hereinafter referred to as “the hirer”). The contract does not become effective until the agreed payment has been received from the hirer in cleared funds and written confirmation has been sent by Anwell Holidays.

2. Booking & Deposit

Upon receiving confirmation from Anwell Holidays that the holiday home and date of your choice is available, reservation may be made by mail, telephone or email. The property will then be held for you for seven working days, enabling the hirer to send the required remittance either in the form of a deposit or full remittance.

For bookings made more than six weeks in advance of the holiday start date a £100 deposit is required to secure the reservation, for which a receipt will be issued.

3. Payment

Six weeks prior to your stay the full balance of the total holiday cost must be received by Anwell Holidays. Payment may be made by cash or cheque. If payment is not received by the stated time period Anwell Holidays reserve the right to cancel the holiday booking, in which case the deposit will be forfeited.

Any booking made less than six weeks prior to the holiday start date must be paid in full immediately upon booking.

4. Security Deposit

A £100.00 refundable security deposit is required payable along with the final balance payment.

The security deposit is fully refundable within 20 days after the holiday let ends providing there is no damage (either willful or accidental) or no additional cleaning required.

5. Cancellation

If the hirer cancels a confirmed booking they remain liable for payment of the full cost of the holiday.
Anwell Holidays recommend that the hirer takes out holiday insurance/cancellation cover. The cost of such insurance is not included in the cost of the hire. In the event that the holiday is cancelled, if requested in writing (email will suffice), Anwell Holidays will attempt to re-let the accommodation on your behalf. If a re-letting is achieved we will refund any monies paid by the new hirer (it should be noted that this may not be the price paid by you, especially if it is a late booking), less an administrative charge of £20.00 and any other expenses incurred in re-letting. If a re-let is unsuccessful all monies paid will be forfeited.


 6. Booking Alterations by the Hirer
Any alterations to a booking by the hirer will be subject to a £20.00 administration charge. Any transfer of a booking to another property will be treated as a cancellation of the original reservation (see clause 5). Any change of holiday dates will also be treated as a cancellation unless otherwise agreed to by Anwell Holidays and owner.

7. Booking Alterations by Anwell Holidays

If for reasons beyond its control, Anwell Holidays has to cancel or alter arrangements made for the hirer; it will make every effort to find an alternative property of an equivalent standard. If the alternative is less expensive than the original we will refund the price difference, if more expensive, you will be requested to pay the difference.

Should the hirer not accept the alternative property offered, Anwell Holidays will return to the hirer any monies paid whereupon the agency’s liability will cease.

8. Damage or Losses

The hirer is responsible for leaving the accommodation in a clean and tidy condition. The hirer further undertakes to pay for any damage or losses incurred during their occupation. Any articles found to be missing or broken from the property or garden area will be paid for by the hirer, as will any damage to the fabric (reasonable wear and tear excepted). Please report any breakages or damages on the Inventory left in the property at the beginning of your stay. By occupying the accommodation without registering any fault or breakage, the hirer accepts responsibility for the unit and its equipment throughout the period of hire.

Anwell Holidays reserve the right to inspect the accommodation before departure and charges may be levied if the unit is not left in a clean and tidy condition. Anwell Holidays reserves the right to repossess the property if any excess damage has been caused by the hirer or anyone else within the property with their permission.

The hirer must acquaint themselves with the safety precautions against fire and the whereabouts of the fire points.

9. Numbers in Party & Eligibility

Unless, by written request and consent received of the owners, the number of people occupying the property must not exceed the maximum number stated in the property description. In the event this should occur the owner/Anwell Holidays or their authorized agent can refuse to allow the hirer to take possession of the property or evict the hirer from the property prior to the termination of your stay. In the unlikely event this should occur, your holiday will be treated as cancelled by you and you will not be entitled to a refund or compensation.

The hirer has no right to sub-let the accommodation or permit more than the agreed number of persons to occupy it.

Anwell Holidays reserves the right to refuse any booking which, in its professional opinion, is unsuitable to the property concerned. Anyone making a booking must be over the age of 21 years. Note: Hen & Stag parties will not be permitted.


 10. Occupancy
Occupation of the property is normally 15.00 hrs on the day of arrival until 10.00 hrs on the day of departure. Any changes to these times should be requested in writing.

If the holiday home is not claimed and occupied within 24 hours of the due time of arrival any right to the property may be forfeited (unless a prior special arrangement is made due to travel related delays, or health matters)

11. Pets

Well behaved pets are permitted in the property but the hirer must not leave them unattended in the house at any time. Pets are not allowed in the bedrooms or on any items of furniture in the property. Only one dog permitted per party unless written permission is obtained. There is a charge of £30 per dog per week in addition to the rent.

Dogs must be under strict control at all times whilst on the property, it should not be assumed that if a garden is described as enclosed this necessarily means it is “escape proof” for dogs or other animals. Any fouling of lawns or patio areas must immediately be cleaned.

If a pet(s) are included in the holiday party the hirer is responsible for any damage or excess cleaning they may cause Anwell Holidays reserve the right to deduct monies for damage or extra cleaning required due to the hirer’s pet.

12. Travel cots & High Chairs

The house is equipped with a cot but not a high chair, please inform Anwell Holidays at the time of booking what your requirements will be.

13. Bed Linen & towels

Please bring your own towels as these are not provided. Bed linen, pillows, duvets and bath mats are provided.


14. Property Description and Liability

Whilst Anwell Holidays make every effort to ensure that property description in its brochure and website are accurate, we cannot be held responsible for any discrepancies which may occur as a result of change made by an owner after publication nor can Anwell Holidays be held responsible for the discrepancies which are beyond its control eg closure of a public house or local shop/post office.

Anwell Holidays and/or the owner(s) of accommodation will not accept responsibility for inaccessibility to any attractions or area amenities mentioned in the brochure or website. Anwell Holidays cannot warrant or accept responsibility for the accuracy of any verbal information or statements made by its servants or agents.

Occasionally properties may differ from the original photographs found in the brochure or internet. The hirer will be notified in writing of any major changes in actual accommodation that may affect the booking, as soon as Anwell Holidays are aware of them.

Whilst Anwell Holidays makes every effort to ensure that brochure and website descriptions are accurate and the properties let meet our required standard, we cannot accept responsibility for any alterations made to the property or its amenities which are beyond its reasonable control nor can Anwell Holidays accept responsibility for any injury, sickness, loss, damage, additional expense or inconvenience, directly or indirectly caused by or arising out of the use or condition of the property and its appearances, plumbing, gas, electrical, exceptional weather conditions or owner’s negligence.

Anwell Holidays accepts no responsibility for the hirer’s personal belongings, car or its contents or that of any of the hirer’s party during their stay.

15. Maintenance

Grass cutting, gardening, window cleaning, external painting etc are all very much weather dependent and the owner’s contractors may need to carry some works on days other than changeover days. Where possible the nominated contractors will always try to accommodate the wishes of, and minimize any disruption to the hirer.

16. Age of the property

Old cottages offer a wealth of character and atmosphere, however, they can be prone to damp patches during wet or humid weather, as moist air can lead to condensation. These problems may be alleviated by good ventilation, particularly whilst cooking or bathing. As a general rule the very elderly, very young or those people sensitive to humidity should avoid such cottages especially in the wettest periods.

17. Complaints

Should the hirer consider that they may have cause for complaint, the matter must be taken up immediately with the local caretaker or directly to Anwell Holidays in order that an investigation may be carried out and if necessary immediate corrective action taken.

No liability shall arise beyond a refund of monies paid to Anwell Holidays. Under no circumstances will Anwell Holidays accept claims for compensation lodged by the hirer upon departure or after return home when it is no longer possible to investigate the complaint effectively or take corrective action.

18. Data Protection


For the purposes of the Data Protection Act 1998, Anwell Holidays are the sole data controller of all personal data provided to us from customers and prospective customers. Anwell Holidays will collection certain personal details from you including your name and address and possibly credit/debit card details.

For your holiday to be provided, Anwell Holidays needs to pass on certain items of your personal details to owners/caretakers.

Anwell Holidays may wish to store and use your personal details for future marketing purposes, including sending brochures or details of promotions to you.

Anwell Holidays may make contact with you by email, post, fax or telephone for the purposes set out in the clause for a period of five years after the end date of the holiday rental. If you do not wish to receive any or all of the communications set out in this clause, please inform us by letter, telephone or email. Anwell Holidays is entitled to assume you do not object to being communicated with as detailed above unless it receives such notice. Except where expressly permitted by the Data Protection Act 1998, Anwell Holidays will only deal with the personal details you give as set out above.

19. Force Majeure

Compensation payments will not apply where we cannot fulfill our obligations to our owners due to circumstances beyond our control. This would mean any event we or the owner cannot foresee with all due care, eg riots, war or threat of war, terrorist activity, civil strife, natural or nuclear disaster, industrial dispute, adverse weather conditions, fire, epidemic or health risk and similar factors beyond our control.

20. Contract

Payment of your deposit and/or the full cost by the hirer constitutes acceptance of these conditions in total.

All contractual obligations arising out of these conditions shall be subject to Scots Law and the exclusive jurisdiction of the Scottish Courts.
